/VIEWALL SECTORS

We work for producers with different types of products, including fruits and vegetables, flowers, plants, bulbs and seed production. This sector is also going through stormy technological developments, ranging from the use of robots with vision technology, smart harvesting machines and energy-smart solutions to vertical farming and DNA technology. We support breeders and other players in the sector, including growers and traders, in protecting and legally establishing their position. With our knowledge of the sector, we oversee the various related roles and responsibilities.
As a member of Plantum and CIOPORA, we stay abreast of developments in the industry and, as a member of the Legal Panel and the Working Group on Enforcement, we contribute to appropriate protection and enforcement of rights including, in particular, plant breeders' and trademark rights.

Consulting

Our in-depth knowledge of IP law and specific experience in the plant breeding industry enables us to advise breeders on the protection of their plant varieties. We are ready with strategic advice on variety fixation and help our clients navigate the regulations of plant breeders' rights and patents. We also guide our clients in drafting licensing and other commercial contracts with chain parties, as well as compliance issues, such as around the AVG and food safety, where the flow of data to and from nurseries, farmers and packing/chilling houses must be carefully managed.

Commercial contracts

We have years of experience in drafting, reviewing and negotiating the diversity of contracts common in the plant breeding industry. Whether it's agreements with nurseries, distribution contracts, or the terms that form the basis for collaborations with farmers, sorting centers or cold stores, our lawyers ensure clear agreements that both safeguard interests and minimize risks.

Disputes

Disputes in the plant breeding industry can be far-reaching, with potential implications for food supply and biodiversity. We have the expertise to assist our clients in protecting their trade secrets and defending their plant breeders' rights in complex disputes over plant varieties. In doing so, we can also cooperate with customs in the Netherlands and other EU countries to intercept infringing producers. This requires knowledge of the industry.

Presentations/Training

The world of plant breeding is constantly evolving and requires a deep understanding of the latest legal developments. Our team therefore provides training courses and presentations focused on the legal nuances of plant breeding, so that our clients are always one step ahead.

We also provide presentations within national and international networks within the sector, such as at Plantum and CIOPORA.
