General Data Protection Regulation

The General Data Protection Regulation (further: AVG), together with more specific national laws and regulations, sets requirements for the careful processing of personal data. Personal data may only be processed in accordance with these rules. Moreover, personal data may only be processed if there is a legal basis for doing so.

Some central obligations under the AVG (see also our AVG mindmap):

- formulation of the purpose of processing personal data
- no further processing incompatible with the purpose for which the data were obtained
- No processing of special personal data unless there is a legal exception for it
- justification for processing, such as unambiguous consent or performance of a contract
- security and data breach notification
- provision of information to the data subject
- data subject's rights, including rights of access, correction and opposition
- transfer to other countries

Failure to comply with the AVG can have various consequences such as enforcement actions by the Personal Data Authority, including the imposition of hefty fines, or liability to data subjects.

An important tool here is the processing register, a requirement under the AVG, which helps manage data processing within your organization. In addition, processor agreements and data sharing agreements are crucial to ensure the security of data processing by third parties.

Role of the data subject and Data Protection Officer (FG)

The data subject, the person whose data is being processed, has several rights under the AVG. It is important for organizations to respect these rights and have clear privacy policies. In larger organizations, the Data Protection Officer (FG) plays a key role in ensuring compliance, monitoring data protection strategies, and serving as a point of contact for the Personal Data Authority.
